Justice Elena Kagan's first vote is against an execution

This vote is because the drug used for LETHAL injection might not be SAFE! Well go figure. If it were safe it wouldn't be lethal. I know that is not the argument used but you would think that logic would laugh this out of court. Maybe we should go back to hanging. Is that rope comfortable enough for you? It isn't chaffing is it? I hope it doesn't give you a rash!

How does a case like this even get before the SCOTUS? Oh, I had a momentary lapse of thought. We have a federal judge in Phoenix and the U.S. 9th Circuit Court of Appeals to thank for momentarily halting the execution for this reason. That's how ridiculous cases like this get to the supreme.
