Governor Brian Schweitzer (D), signs revolutionary new gun law in Montana

I would say that Montana has thrown down the gauntlet. What this boils down to is:
  • Guns andammo made, sold and used in Montana does not require any federal forms.
  • Silencers made in Montana and sold in Montana would be fully legal and not registered.
  • There would be no firearm registration, serial numbers, criminal records check, waiting periods or paperwork required.


Moving to Montana soon.

The Alaska House of Representatives passed a virtually identical bill in April, but it did not pass the Senate ... yet.

I expect that neither will stand up in court as there precedence against it. Does make a firm statement though.

There is nothing in the second amendment that allows for the regulation of firearms.

For example, silencers are only illegal because some bureaucrats think they should be illegal. In some countries in Europe they are legal and hunters love the fact they do not have to wear hearing protection.

If you have ever fired a pistol with a silencer you will love the fact that hearing protection is not necessary and it reduces your inclination to flinch from the loud report.

There are more than 11,000 regulations against firearms and the vast majority are unconstitutional and are on the books only because the average person cannot file a lawsuit all the way to the supreme court.

IMHO- All these laws would only be constitutional if they were to amend the Constitution which they have not attempted and relied on anti gun judges to make law from the bench.

What is neat about the stand in Montana is that silencer's are considered "destructive devices". (form 4) It may not take them too long to include full auto for made in Montana. Regards, 5thmilitia

Let's include the whole Firearms Act of 1936, Montana! Isn't it just amazing how well and clear thinking one can be when they breathe the pure air of Montana? Texas has a similar bill just introduced. If the Feds oppose this, maybe we all should secede from the Union. Take that, New World Order! As they say in Ireland:
